JOHANNESBURG - Advocates for Transformation (AFT) are warning public officials to refrain from deliberately misinterpreting the Constitutional Court judgment on Nkandla, saying it amounts to a criminal offence.
The court found that President Jacob Zuma failed to uphold, defend and respect the Constitution by ignoring the Public Protector's remedial action over Nkandla.
The association says it's disturbed by the utterances made by the ruling party and members of the executive about the judgment.
AFT say the National Assembly and the executive must demonstrate their commitment to keep to the letter and the spirit of the Constitution by acting upon the findings of the court.
AFT says given the finding that the president failed to uphold the Constitution, and in view of the fact that the president took an oath to uphold and protect the Constitution, there can be no doubt that he has failed to implement and observe his oath of office.
"Any view to the contrary is a deliberate attempt to twist the words used in both the judgment and the oath."
It has warned that misinterpreting the clear words of the court amounted to the criminal offence of contempt of court, for which perpetrators can be committed to prison.
